Landscaping Millhill Service Terms and Conditions

Landscaping team preparing a garden projectThese Terms and Conditions set out the basis on which Landscaping Millhill provides domestic and commercial landscaping services in the UK. By making a booking, confirming a quotation, or permitting work to begin, the customer agrees to these terms. These conditions are intended to create a clear understanding of how our landscaping services operate, including the booking process, payment terms, cancellation rights, liability limits, waste handling obligations, and the law that governs the agreement.

For the purposes of these terms, “we”, “us”, and “our” refer to the landscaping service provider, and “you” or “the customer” refers to the individual or business purchasing services. The terms apply to all services arranged through written quotation, telephone discussion, email confirmation, or any other agreed method of instruction. Unless we expressly agree otherwise in writing, these terms shall apply in full to all landscaping work undertaken.

Our services may include garden maintenance, soft landscaping, hard landscaping, turfing, planting, fence-related landscaping works, ground preparation, clearance, and similar outdoor works. Each landscaping project is subject to site conditions, access, weather, materials availability, and any specific instructions agreed before work starts. Any variation to the agreed scope must be confirmed and may affect the price and schedule.

1. Booking Process

The booking process begins when you request a quotation or proposal for landscaping services. We may provide an estimate based on photos, measurements, site notes, or an inspection. An estimate is not a fixed offer unless stated otherwise. A binding quotation will normally set out the scope of work, the anticipated duration, any exclusions, and the price basis. A booking is only confirmed when you accept the quotation and we confirm the date, or when a deposit or written instruction is received and acknowledged.

Before work starts, you must provide accurate information about the site and the intended works. This includes details of access routes, underground services where known, water and electricity availability, parking restrictions, protected trees, shared boundaries, planning restrictions, or any other matters that may affect the work. If information provided by you is incomplete or incorrect, we may need to amend the quotation, alter the schedule, or pause the project until the issue is resolved. Any delay or additional cost arising from inaccurate information may be charged to you.

Quotation and booking paperwork for landscaping servicesWe reserve the right to refuse or postpone a booking where site conditions are unsafe, access is not reasonably available, weather conditions make the work impractical, or the requested services are outside our scope or competence. If a booking is made for a particular date, that date is an estimate unless we have agreed a fixed date in writing. We will use reasonable efforts to attend on the scheduled day, but landscaping work is often affected by weather, seasonal conditions, supply delays, or operational issues beyond our control.

2. Pricing and Payments

All prices are stated in pounds sterling unless otherwise agreed. Quotes may be fixed-price or estimated depending on the nature of the work. Fixed-price quotations apply only to the exact scope described in the quotation. If you request changes, additional works, or there are hidden site conditions requiring extra labour or materials, we may issue a revised price. Landscaping services may also be subject to charges for waste removal, specialist equipment, additional visits, or material price changes if these were not included in the original quotation.

Unless expressly stated otherwise, invoices are payable within the payment period specified on the invoice. For residential customers, we may request a deposit before starting work, particularly for larger landscaping projects or where materials must be ordered in advance. For commercial clients, staged payments may be required according to milestones or progress. We may suspend work if any invoice is overdue, if a deposit is not paid, or if there is a reasonable concern that payment may not be made in full.

Materials and tools arranged for landscaping workIf late payment occurs, we reserve the right to charge interest and reasonable recovery costs to the extent permitted by law. Payment by bank transfer is normally preferred, although other methods may be accepted at our discretion. You are responsible for ensuring that payment is made in full and cleared funds. Any bank charges, failed payment fees, or currency conversion costs are your responsibility unless the failure is due to our error. Ownership of any supplied materials may remain with us until payment is received in full, where permitted by law.

3. Changes, Delays, and Cancellations

You may request changes to the agreed landscaping work before or during the project. We will consider each request in good faith, but any variation may affect cost, timing, and material requirements. We are not obliged to proceed with a change unless the revised terms are agreed. If a change increases the overall scope, we may require additional payment before continuing. Where a change reduces the scope, the price may still be adjusted to reflect time already spent, materials ordered, and any non-refundable commitments incurred.

If you wish to cancel a booking, you must notify us as soon as possible. Cancellation charges may apply depending on how much notice is given, whether materials have been ordered, whether labour has already been allocated, and whether specialist equipment has been reserved. If cancellation occurs after work has commenced, you will be charged for work completed, materials used or ordered, and any costs reasonably incurred up to the point of cancellation. Deposits may be non-refundable to cover administration and reserved resources, unless required otherwise by law.

We may cancel or reschedule a booking where circumstances make performance impossible or unsafe, including severe weather, supply chain disruption, illness, emergencies, unsafe ground conditions, discovery of hidden hazards, or acts beyond our reasonable control. If we cancel, we will aim to offer a new date or refund any prepaid sums for work not carried out, except for amounts already properly due for work completed or materials supplied. We shall not be liable for losses arising from delay where the delay is caused by events outside our reasonable control.

4. Customer Responsibilities

You must ensure that the site is accessible and reasonably prepared for the agreed work. This includes removing fragile items, securing pets, protecting valuables, and advising us of any hazards such as uneven ground, concealed drainage, electrical cables, contaminated soil, asbestos, or fragile structures. If the site contains conditions that present a risk to health, safety, or property, we may stop work until the issue is addressed. Any time lost due to inadequate preparation may be charged as an additional cost.

You are responsible for obtaining any permissions, consents, licences, or approvals required for the landscaping work, unless we have expressly agreed to arrange them. This may include permission from freeholders, neighbours, management companies, planning authorities, or utility providers. We are not responsible for breaches of third-party rights, restrictive covenants, or planning rules unless the breach is caused by our negligence or a failure to follow your written instructions. You should check that any proposed work is suitable for the property and its intended use.

Where plants, turf, timber, stones, or other materials are selected by you, we are not liable for variation in appearance, natural ageing, or minor differences in colour, size, grain, or texture, as such variation is normal in landscaping materials. Living materials are subject to seasonal change and natural biological variation. If you choose a particular planting scheme or finish against our advice, you do so at your own risk, unless we have expressly agreed in writing to guarantee a specific result.

5. Quality of Work and Liability

We will carry out landscaping services with reasonable care and skill and in accordance with the agreed quotation, any written specification, and applicable standards. If you believe work is defective, you must notify us within a reasonable time after completion or discovery of the issue. We may inspect the matter and, where appropriate, offer to repair, replace, or rework the affected area. This remedy may be our first option before any refund or compensation is considered, except where the law requires otherwise.

Our liability is limited to losses that are a foreseeable result of our breach of these terms or our negligence. We are not responsible for indirect or consequential losses, including loss of profit, loss of enjoyment, loss of business, or costs arising from interruption to your use of the property, except where such exclusion is not permitted by law. Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot lawfully be excluded.

Where we rely on measurements, drawings, or specifications provided by you, we shall not be liable for errors arising from incorrect information supplied by you. Any recommendations we make regarding planting, drainage, materials, maintenance, or aftercare are given in good faith, but final suitability can depend on site conditions and future weather. We do not guarantee plant survival, lawn establishment, or long-term performance unless a specific guarantee is stated in writing and the stated conditions are met.

Waste collection and site clearance during landscapingWe shall not be liable for damage to hidden pipes, cables, roots, drains, or other concealed features where they were not reasonably identifiable and you did not inform us in advance, provided we have taken reasonable care. If we identify a potential hazard, we may pause work and seek instructions. Any damage caused by pre-existing weakness, subsidence, poor installation, faulty structures, or third-party interference is excluded to the extent permitted by law. You remain responsible for arranging appropriate insurance for your property and any high-value items on site.

6. Waste Handling and Environmental Compliance

Landscaping services often generate soil, branches, turf, packaging, rubble, and other waste materials. We will handle waste in a lawful and environmentally responsible manner, and we may remove waste as part of the service if agreed in advance. If waste removal is included, we will manage disposal through suitable facilities or authorised carriers where required. If waste removal is excluded, you must make your own arrangements for storage, removal, or disposal of waste generated by the works.

We will comply with applicable UK waste regulations, including requirements relating to duty of care, segregation, transport, and disposal of controlled waste. You agree not to ask us to dispose of prohibited, hazardous, or undocumented materials unless we have expressly agreed and are legally able to do so. Where waste is to be removed, we may ask you to confirm the type and source of the waste. If waste is found to be contaminated, unusually heavy, or otherwise outside the assumptions of the quotation, additional charges may apply. We may refuse to remove waste that cannot lawfully be handled under the agreed service.

7. Materials, Plant, and Property Access

Materials supplied by us remain subject to availability and may be substituted with similar items where necessary, provided the substitution is reasonable and does not materially reduce the quality of the finished landscaping work. If specific items are unavailable, we may suggest alternatives. Any samples, images, or descriptions are indicative only and may vary slightly from the delivered materials. Where materials are supplied by you, we are not responsible for defects in those materials unless the defects should have been obvious on reasonable inspection.

You must ensure that we have safe access to the property and that any necessary parking, loading, or delivery arrangements are available where reasonably possible. If access is obstructed or limited, we may be unable to complete the work in one visit, which may increase costs. We are not responsible for delays caused by restricted access, blocked entrances, locked gates, or failure to provide agreed access arrangements. If we have to return due to access problems not caused by us, a further call-out charge may be applied.

Finished outdoor landscaping area under UK service termsAny property, fittings, ornaments, or surface coverings that may be at risk should be removed or protected by you before work begins. Although we take reasonable care, outdoor works carry inherent risks such as accidental disturbance, dust, vibration, or temporary disruption. We are not responsible for damage to items that should reasonably have been moved, covered, or protected by you, unless the damage results from our negligence. Please note that some degree of disturbance is normal during landscaping and does not itself amount to a breach of contract.

8. Force Majeure

We shall not be in breach of these terms if we are prevented from performing any obligation due to events beyond our reasonable control. These may include extreme weather, flood, fire, pandemic restrictions, industrial action, shortages of materials, transport disruption, governmental restrictions, power failures, or serious illness. In such circumstances, we may suspend, reschedule, or cancel the affected work without liability for the delay or non-performance, although we will aim to minimise disruption and provide reasonable notice where possible.

If a force majeure event continues for an extended period, either party may discuss termination of the affected booking. Where work has partially been completed, you must pay for the proportion completed and for any materials or services already committed to the project. Any unused prepaid balance may be returned after deduction of sums properly due. Neither party shall be liable for indirect losses caused by force majeure, provided reasonable steps were taken to limit the impact.

9. Governing Law and General Terms

These Terms and Conditions and any dispute or claim arising from them shall be governed by and interpreted in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction over any dispute unless mandatory consumer law says otherwise. If any part of these terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. No waiver of any term shall be effective unless made in writing and signed or otherwise clearly agreed by us.

We may update these Terms and Conditions from time to time. The version in force at the time of your booking will normally apply to that booking, unless the law requires a change or the parties agree to a later version in writing. If any inconsistency arises between a quotation and these terms, the specific written quotation will prevail only to the extent of the inconsistency and only for that particular item. These terms are intended to provide a fair and practical framework for landscaping services while protecting the rights of both parties.

By proceeding with a booking for Landscaping Millhill services, you confirm that you have read, understood, and agreed to these terms. You also confirm that you are authorised to instruct the work on the property in question and that, to the best of your knowledge, the information you have provided is accurate. Continued engagement after receipt of an updated quotation or amended schedule shall be treated as acceptance of the revised terms relating to that project.
